Major Site Plan Approval, Conditional Use Approval, C(2) Variance Relief, Design Waiver

Jeffrey P. Barnes, Esquire, represented an applicant seeking approval in order to construct a new three-story mixed-use building consisting of a commercial use on the first floor and one three-bedroom residential unit on each of the second and third floors together with six off-street parking spaces at a property located in the CB-1 zone. Preliminary and final major site plan approval, conditional use approval to allow residential units above the ground floor commercial use, variance relief for minimum commercial floor area and minimum parking area setbacks, and a design waiver for enclosed refuse areas were granted. The application was heard on March 2, 2022, by the Ocean City Planning Board.
