Jeffrey P. Barnes, Esquire, represented an applicant seeking approval in order to demolish two existing dwellings and conduct a three-lot minor subdivision to create three new residential building lots while reducing the area of the adjacent property which contained an existing nonconforming use at a property located in the C-2-40-4000 zone. Minor subdivision approval, D(2) variance for expansion of a nonconforming use at the adjacent property, waiver for topographical data, and C(2) variance relief for height, building coverage and impervious coverage at the adjacent lot were granted. The application was heard on March 16, 2022, by the Ocean City Zoning Board.
